Public Hearing re: Local Law #1 to Update the Village's Zoning Code

Local Opt-Out of Cannabis Retail Dispensaries or On-site Consumption The Village of Hamburg Board of Trustees is weighing the option to opt-out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses from locating within the Village. On March 31, 2021, New York State legalized adult-use cannabis (also known as marijuana, or recreational marijuana) by passing the Marijuana Regulation & Taxation Act (MRTA). The Act also contained provisions for the establishment of retail cannabis outlets throughout the State of New York. Specifically, the Act allows cities, towns, and villages to opt-out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses from locating within their jurisdictions. To opt-out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses, a municipality must pass a local law by December 31, 2021. If a municipality does not opt-out by December 31, 2021, the municipality will be unable to opt-out at a future date. However, at any time a municipality may opt back in, to allow adult-use retail dispensaries and/or on-site consumption licenses, by repealing the local law which established the prohibition. It is important to note that municipalities cannot opt out of adult-use legalization. Possession and use of cannabis by adults 21 years of age or older is legal in New York State.

1) Email the Village Board by emailing mayor@villagehamburg.com 2) Write the Board by sending your letter to: Village of Hamburg, 100 Main Street, Hamburg, NY 14075 3) Speak to the Board in person at an upcoming Board meeting. Meetings are held at Village Hall, 100 Main Street. Public expression occurs at 7pm. The board will meet on the following dates: November 15 and December 6.
